Comprehensive User Agreement & Privacy Policy

A. Terms & Conditions

1. Introduction

• This agreement “Terms of Use” is legally binding between you (“User”) and HIGHNET STREAMING SERVICES LIMITED (“Company”).
• Applies to the HIGHNET website, applications, and platforms (“Platform”).
• HIGHNET is a content aggregator and navigator: it does not host/stream third-party content, only guides users to it.
• By accessing or using the Platform, you agree to these Terms and Privacy Policy. If not, you may not use the Platform.

2. Service Overview

• Content Discovery Platform: Aggregates content from a wide variety of providers plus exclusive HIGHNET Originals.
• Users are redirected to the original platform for third-party content or can stream HIGHNET Originals on-site.
• Features: Personalized recommendations, support for a wide range of devices, and exclusive original content.

3. Platform Use and Restrictions

• For individual, non-commercial use only.
• No broadcast/sharing/redistribution of content allowed. Commercialization is prohibited.
• Violations are subject to legal action under copyright law.

4. Content Aggregation Role

• Acts only as a content navigator. No hosting, storage, or direct streaming of third-party content.
• All third-party content is played on that provider’s own website/app.

5. Third-Party Content Disclaimer

• Links and integrations are for user convenience only.
• HIGHNET is not responsible for third-party content, practices, or privacy policies.
• User interactions on third-party platforms are at their own risk.
• Users should review third-party terms and privacy policies.

6. User Awareness and Responsibility

• You are responsible for content you choose to view, especially if it’s religious, political, adult, offensive, or controversial.
• HIGHNET is not liable for any emotional, reputational, or legal impact from voluntary engagement with such content.
• Discretion and parental controls are user’s responsibility.

7. User’s Obligation in Case of Dispute

• All legal issues must be addressed directly with the content provider/platform.
• HIGHNET is a neutral intermediary and may not be named in legal disputes unless ordered by Indian courts.

8. Conclusion of User Responsibility

• By using the Platform, you waive claims against the company for third-party content, agree to indemnify HIGHNET, and accept responsibility for your viewing choices.

9. Responsibility for Content Viewed

• Intentional access to sensitive or explicit content is presumed voluntary.
• Users are solely responsible for suitability for minors in their care.

10. Children’s Privacy

• Platform is accessible by users under 13 only with guardian supervision.
• HIGHNET does not knowingly collect data from children, and parents are responsible for appropriate monitoring and content restrictions.

12-13. Technical Limitations & Safety Compliance

• HIGHNET strives for high performance, but cannot guarantee uninterrupted flawless operation especially after content is uploaded to personal devices.
• Industry-standard protections are applied, but company is not liable for device issues caused by factors outside their control.

14. Legal and Regulatory Compliance

• Operates per: The Information Technology Act, 2000, IT Rules 2021, Copyright Act 1957, Consumer Protection (E-Commerce) Rules 2020.

15. Viewer/Customer Responsibilities

• Use services lawfully (no VPN bypass, no piracy, etc.).
• No copying or redistribution allowed.
• No impersonation, bots, click fraud, etc.
• Parents/guardians must monitor children’s access.
• Users accept full responsibility for viewing explicit or offensive content.

16. Content Ownership

• All third-party brands/logos are for navigation/info only.
• All IP belongs to its respective owners. Playback occurs externally. HIGHNET claims no ownership over third-party material.

17. Acceptable Use

• Strictly for personal, non-commercial use. Redistribution or public display is forbidden.
• No circumvention of security or DRM protections.

18. Content and Availability

• Content discovery only; no storing or hosting by IGHNET.
• Content availability is subject to third-party platform agreements/licensing.
• Service and content may be unavailable or interrupted by third-party issues. Direct discrepancies to the host platform.

19. Limitation of Liability

• HIGHNET is not liable for indirect, incidental, or consequential damages, including content issues, data loss, or downtime.

20. Governing Law & Jurisdiction

• Governed by Indian law, with exclusive jurisdiction in courts at Ludhiana, Punjab.
• Disputes should attempt mutual resolution before litigation.

B. Privacy Policy

1. Introduction

• By using HIGHNET, you agree to data collection/storage/processing as described.
• Protecting your data is taken seriously; responsibility is also on the user to safeguard their account/passwords.

2. Information We Collect

• Personal Data: Name, phone, email, preferences.
• Technical Data: IPs, device IDs/OS, cookies.
• Behavioural Data: Viewing history, interactions, clicks.

3. Legal Basis for Processing

• User consent, contractual necessity, legal obligations, or legitimate interest.

4. Use of Data

• For personalizing recommendations, platform improvement, communication, and compliance.

5. Virus Protection & Safety

• Robust security is practiced but company is not liable for damage from third-party apps/websites or user devices.

6. Third-Party Platforms

• HIGHNET redirects to third-party services. Their privacy practices apply, not HIGHNET’s.
• HIGHNET is not liable for data misuse or breaches on those platforms.

7. Your Rights (as per Indian law)

• Request access, correction, or deletion of your data.
• Withdraw consent, or opt out of promotional communication.

8. Data Sharing

• Data shared only with: authorized service providers, lawful authorities, or successor entities in case of business transfer.

9. Children’s Privacy

• Children under 13 must have parental supervision. No intentional data is collected from minors without consent.
• Use of parental controls is strongly advised; data is deleted if discovered to be collected from a child without consent.

10. Data Security

• Uses encryption, access controls, security audits.
• No system is fully immune; users must maintain privacy when interacting with third-party links or devices.

11. Policy Changes

• Updates are posted on the platform and communicated.
• Continued use after notice constitutes acceptance.
